The 2011 Consumer Rights Directive will, from 2013, introduce important changes to the law as it affects consumers and those who sell goods and provide services to them, especially in the online environment. The new Directive brings together currently distinct laws for ‘distance contracts’ and other consumer contracts. |

Persistently in Default - Wood Products Ltd |
The Supreme Court determined what is meant by a company being persistently in default regarding the filing of the annual returns; “persistent default is not merely default which has continued over a long period of time but is default which has continued in the teeth of intervention on the part of the courts more than once.” |

Tralee Beef & Lamb Supreme Court Appeal |
A Non-Executive Director of Tralee Beef & Limited, Simon Coyle, won his appeal in the Supreme Court against a restriction order handed out by the High Court. In this case, the liquidator had recommended in his Section 56 Report that Simon Coyle should avoid restriction. The Office of the Director of Corporate Enforcement refused to grant relief from bringing the restriction proceedings. The High Court subsequently restricted Simon Coyle from acting as a Director. |
